Kramer, who recently joined Brinkley Morgan.
Bill is Florida Bar board-certified as a specialist in real estate law. His practice areas include real estate, business and corporate law. He represents banks, lenders, investors, developers and builders in real estate matters and also serves as outside counsel to a number of businesses and health care practices.
Q: What do you like most about practicing law?
A: When I was in college considering various professions and vocations, I wanted to do something that would be interesting and challenging, helpful to other people, and provide me with an opportunity to make a good living. I have found practicing law meets these criteria. As a transactional lawyer, I am generally more involved in crafting solutions than trying to ?beat? the other side. With that said, it is essential to structure a transaction in a manner most favorable to one?s client. Brinkley Morgan?s strong team of litigators and broad expertise provides the leverage necessary for successful negotiating.
Q: Is there a recent case that illustrates why you enjoy practicing law?
A: Recently, I forged the settlement of a commercial foreclosure case in which my clients were mostly principals of the borrowing entity and individual guarantors. We were able to settle the matter by finding a buyer for a difficult property, negotiating a substantial reduction in the loan payoff, and working out a settlement among the warring factions of the borrower entity. This case was challenging and the litigation could have dragged on for several years, which would not have been advantageous to any of the parties involved. It was important that a short sale occur. I found that perseverance, attention to detail and maintaining a relationship of civility, willingness to negotiate and open communication with opposing counsel led to a successful outcome.
Q: What are some hot issues in your practice area?
A: The majority of my practice involves some form of distressed property, whether representing lenders, borrowers attempting to get out from under a bad loan, or investors or developers attempting to acquire a property or loan at a very good price. It is important to understand when it?s advisable for a lender to get rid of a loan and/or property instead of proceeding with a foreclosure and acquiring title. It also is important to understand the potential protections for borrowers and/or guarantors available under bankruptcy law.
Others matters I see regularly in my practice include foreclosure defense issues involving lender authority, disclosure and traceability of loan documentation, environmental issues, and the general conservatism of lenders.
Q: What hobbies or interests do you enjoy outside the office?
A: I am an avid tennis player, golfer, runner, gym rat, scuba diver, and skier.
Q: Is there anything else you would like to share?
A: I am extremely excited about joining Brinkley Morgan and look forward to working with the firm?s very talented lawyers who bring a wealth of legal expertise to assist my clients and me.
